Gujarat: HC rejects petition seeking abortion of 14-year-old rape victim

There is no provision of abortion if the pregnancy has crossed 24 weeks, the HC noted.

The Gujarat High Court on Thursday rejected a petition seeking abortion of a 14-year-old rape victim from Sabarkantha district in north Gujarat. The petition was moved by father of the girl. The victim is more than 24 weeks pregnant ​and is studying in 10th standard.

While rejecting the petition Justice Abhilasha Kumari noted that the pregnancy of the victim has crossed the permissible limits for granting termination as per law. There is no provision of abortion if the pregnancy has crossed 24 weeks. However, she ordered the local authority to take care of the girl. She also ordered the government to pay Rs 1 lakh compensation to the victim’s family.

This is the third such case in Gujarat courts in the past four months. Earlier this month, a sessions court in Ahmedabad allowed a city-based government hospital to terminate the pregnancy of a woman suffering from a mental disorder. In April, the High Court had rejected the abortion plea of a Botad gang rape victim, who eventually gave birth to a boy this month at a government hospital in Bhavnagar.

The fresh petition was moved earlier this month by victim’s father, who repairs cycle tyres for a living. The girl was raped by a local doctor some four months ago when she had gone to the doctor for a health check up. After bing threatened by the accused doctor she did​ not ​complain immediately. A couple of months later she fell ill and was later admitted to the hospital where her pregnancy was detected. ​
