The Centre on Wednesday came out with detailed guidelines laying down the factors to be taken into consideration to deal with non-performers or officers of doubtful integrity. The guidelines strengthen the system of periodical review to compulsorily retire officials in “public interest”.
As per the Fundamental Rule 56(J), the government has an absolute right to retire, if necessary in the public interest, any Group A and B employee who joined service before the age of 35 and has crossed the age of 50. Group C government servants, having crossed the age of 55, can also be retired prematurely under the rules.
Now, while “considering integrity of an employee”, the government will take into account “actions or decisions taken by the employee which do not appear to be above board”, “complaints received against him”, and “suspicious property transactions”, the Department of Personnel and Training (DoPT) said.

It has, however, been clarified that “compulsory retirement shall not be imposed as a punitive measure”.
The development follows recent instructions from Cabinet Secretary Pradeep Kumar Sinha that underscored the need for rotation of officers working in sensitive and non-sensitive posts and called for a review of non-performing officers to ensure probity among government servants.
