While hearing petition filed by three Punjab IT officers seeking directions to the department to relieve them so they could join the governance reforms department (GRD),the counsel for petitioners apprised the Punjab and Haryana High Court that transfers of 12 IT employees had been effected by an order dated May 22 after getting approval of the chief minister. Seven of the 12 employees were allowed to join the GRD,while five,including the three petitioners,were not relieved. They therefore,approached the high court. This is in contrast to a written statement,dated October 5,2012,by Director (GRD) V N Zade. It had stated that the proposal of the GRD approved\ by CM does not include the names of 12 employees of the IT department. Following this,the court on October 12 last year had directed the secretary (GRD) to file an additional affidavit to clarify the stand taken by the state. Advocate H C Arora,counsel for petitioners,claimed that the affidavit filed by secretary (GRD) stated:
The council of ministers,in its meeting on October 23 has superseded the order of May 22. The council also approved the transfer of seven employees relieved by the IT department
in Directorate of Governance Reforms… Arora argued that the CMs decision was purportedly superseded by the ministers. The HC on Wednesday directed the state to produce the file containing the proposal that superseded the CMs directions.
