Another witness contradicts ATS claim that Baig was in Pune on blast day

A teacher (name withheld) of a Brihanmumbai Municipal Corporation (BMC) school in Malad,who was a schoolmate of Mirza Himayat Inayat Baig — accused in the German Bakery blast case — deposed in the court on Saturday that Baig had introduced him to Faiyyaz Kagzi and Zabiuddin Ansari alias Abu Jundal in 2006.

“Baig and I studied in the same school in Beed and in 2006 he introduced me to Kagzi and Ansari alias in Beed,” he said while being examined by special public prosecutor Raja Thakare before additional sessions judge N P Dhote,who is hearing the case.

Kagzi and Jundal was absconding after the Aurangabad arms haul case of May 2006 in which a huge cache of 43 kg RDX,16 AK-47 rifles,3,200 live cartridges,62 magazines and 50 hand grenades were recovered from Aurangabad highway and Malegaon. While Kagzi is still absconding,Jundal has been arrested and is in judicial custody till November 3.

Meanwhile,in another development,the second witness (name withheld) contradicted ATS claims that Baig was in Pune on February 13,2010,the day of German Bakery blast. He was examined by advocate Thakare on the point of Baig having introduced himself as a social worker. During his cross-examination by defence advocates A Rehman and Kaynat Ali Shaikh,the witness said that he had had an interview for the post of laboratory assistant in Aurangabad. “At that time,Baig was in Aurangabad. When I called him,he asked me to come over and accompany him to a wedding reception in Aurangabad. Accordingly,I went there on February 12,2010 and met Baig in Aurangabad on February 13,2010 around 8pm,” he told the court.

This contradicts the ATS chargesheet that states,“The wanted accused Ahmed Siddibappa (alias Yasin Bhatkal) and the arrested accused Himayat Baig traveled from Poolgate bus stand to Pune railway station in a rickshaw and then from Pune railway station to central mall in a different rickshaw. Ahmed Siddibappa proceeded to the German Bakery around 5 pm and planted the bomb which was kept in a haversack. The bomb exploded at 6.50 pm causing the death of 17 persons and seriously injuring 56.”
