The Assembly on Monday passed a Bill to change the titles of certain Acts from Bombay to Maharashtra or Mumbai as per the reference. The Maharashtra (Change of Short Titles of certain Bombay Acts) Act,2011 will bring changes in titles of 84 Acts that were in force in the erstwhile Bombay Presidency prior to the formation of the state in 1960 such as the Bombay Police Act of 1951,Bombay Shops and Establishments Act of 1948,Bombay Nursing Home Registration Act of 1949,Bombay Land Requisition Act of 1948,Bombay Motor Vehicles Tax Act in which Bombay will be replaced with Maharashtra.
Departments were asked to identify Acts that bear the title Bombay and a list of 84 has been compiled. Two such exercises were conducted in the past. The titles of these Acts are being changed to Maharashtra and Mumbai or Greater Mumbai as per the provisions. Gujarat government had enacted similar changes in 2011, Minister Naseem Khan said while proposing the Bill.
Sena group leader in the House Subhash Desai said there are 169 Acts that need to be renamed and it was improper to bring an Act that changes the titles of only 84 Acts. He asked the government to ensure that titles of other Acts are also changed.
Chief Minister Prithviraj Chavan states in the Bill that under the Bombay Re-organisation Act,1960 that came into force from May 1960,a new state of Gujarat was formed and the residuary State of Bombay continued under the name of the State of Maharashtra,and the Bombay Acts in force in the said state of Bombay continue to apply in the state of Maharashtra,with the necessary adaptations made therein but with the old short titles with the word Bombay in the beginning. The government of Maharashtra therefore considers it expedient to amend the said Bombay Acts to change their short titles from Bombay Act to Maharashtra Act to facilitate their citation by more appropriate short titles in the future and to make certain consequential and incidental provisions.
