The Punjab and Haryana High Court Thursday issued notice to Haryana government and Panchkula MLA Gian Chand Gupta on a petition challenging the state government’s decision to give Gupta the status of a minister of state.
The petition filed by advocate Jagmohan Singh Bhatti came up for hearing before the division bench comprising Justices SS Saron and Lisa Gill.
Though the petitioner has also challenged the cabinet minister status given to Haryana Advocate General Baldev Raj Mahajan but the court refrained from issuing notice to him and observed that the status of an Advocate General is above that of a cabinet minister and it was indeed an insult of the post by the state government.
Bhatti has submitted that the strength of Haryana cabinet has gone above the constitutional cap of 15 percent of the total MLAs. He had submitted that though the strength of cabinet in Haryana was 14, including the Chief Minister, but later Mahajan was given the cabinet minister status and the BJP chief whip Gupta of that of a minister of state.
