Maharashtra: Filing an appeal in SC against Baig’s acquittal, state tells Bombay High Court

THE STATE government Friday informed the Bombay High Court that it is filing an appeal in the Supreme Court against Bombay High Court’s order acquitting Mirza Himayat Baig, the lone convict in the 2010 German Bakery blast case.

The court was hearing several petitions which alleged that investigative agencies had a pattern of picking up Muslim men as accused in terror cases. The petitioners cited examples of the German Bakery blasts, 7/11 blasts and the 2006 Malegaon blasts. The court disposed of the petition stating it could not entertain the petition during pendency of the proceedings.

“We cannot go into these cases. For example, in the German Bakery blast case, it appears that the state has referred an appeal in Supreme Court and proceedings are pending. As far as 2006 Malegaon blasts is concerned, the state has filed an application challenging the order of discharge of the nine accused in the High Court. It will not be appropriate for us to make adjudication as it may affect the proceedings,” said the court.
