J&K HC stays suspension of two school teachers

The Jammu Kashmir High Court stayed the suspension of two school teachers, saying that it seemed to be the outcome of clash in powers of two senior authorities in the state government.

“It seems a clash in powers of two authorities at a high level, one being the Director School Education and the other, the District Development Commissioner of a district,’’ observed Justice Janak Raj Kotwal after hearing Sudershan Sharma advocate appearing for the petitioners.

Staying the suspension of Talib Hussain and Riaz Ahmed, both posted in hilly Doda district, Justice Janak Raj Kotwal asked the Chief Secretary to look into the matter so that such avoidable situations leading to harsh action against employees are avoided in future.

Talib was posted at higher secondary school at Doda and Riaz at higher secondary school at Desa. On February 17, Director School Education transferred the former to the office of Zonal Education Officer at Bhatyas and the latter to Zonal Education Officer, Ghat.

Before both the teachers could be relieved, District Development Commissioner, Doda, issued an order on February 29 retaining them at their original place of postings till suitable replacement was provided. He marked a copy of the order to Director School Education at Jammu as well.

However, following failure of both the teachers to report at their new place of positing in view of her transfer order, Director School Education suspended them. Both the teachers approached the state high court challenging their suspension.
