The Gujarat High Court on Monday allowed a 16-year-old rape victim to abort her eight-week foetus under medical care and sought details of the medical report to be submitted before it on Tuesday. The court granted the relief on a petition moved by girl’s father last week.
The single bench of Justice K J Thaker allowing the termination ordered that “state is permitted to take the girl for abortion to Civil Hospital, Sola as prayed for by the petitioner. The abortion, if any, shall be carried out after collecting / securing evidences necessary for the prosecution to prove its case including DNA samples etc…”
The petitioner’s lawyer Manoj Shrimali said that the police inspector of Sola police station, where the FIR has been lodged, was also present with case papers before the court. He said that the court directed that the victim should be examined by the doctors of the civil hospital for the purpose of medical termination of her pregnancy. The state government didn’t oppose the petition.
The petitioner, a resident of Ahmedabad, is an auto-rickshaw driver. He has alleged that one Sanjay Thakore,22, who was once his neighbour allegedly lured the girl away from her family on December 6. A day later when she was found she told her parents that she knew Thakore for over a year who allegedly raped her thrice at different places. On December 12 when she was admitted to the hospital for medical examination her pregnancy was confirmed.
This year this is the fifth case of girls with rape-induced pregnancies.
