Bill paternalistic, anti-liberal, must be reconsidered, says Congress

Arguing that the surrogacy Bill cleared by the Union Cabinet resembles “a draft of the stone ages”, the Congress on Friday made it clear that it wants the Bill to be redrafted. The main opposition party said the Bill was “paternalistic” and “anti-liberal” and must be “reconsidered”.

“The new Bill approved by the Cabinet seems to be something resembling a draft of the stone ages,” Congress spokesperson Abhishek Singhvi said. He said the government had taken a “most anti-liberal approach, not at all contemporaneous with the social milieu in which we live, not contemporaneous with the 2016 of India besides non-progressive and non scientific… And all kinds of value judgements have been injected into it in a very paternalistic manner,” he added.

The Congress questioned the insistence that surrogacy can be allowed only through close relatives, and criticised the punishment proposed in the Bill for violations.

“Ten years imprisonment? I think this government has gone back to the stone ages. They have delegated the drafting of the surrogacy Bill probably to the surrogate RSS. It appears to be a surrogate delegation to surrogate agencies, whether you call them the RSS or VHP. This is totally out of tune with contemporary realities and we hope and trust that a wider consultative process will follow….this certainly I doubt very much will meet any form of parliamentary approval….It must be reconsidered,” Singhvi said.

“Why will you have surrogacy at all if it is restricted only to married couples?… Surrogacy is desired by unmarried and single people, divorcees, widows, foreigners, live-in couples, childless couples. All those categories are banned… This is an extremely anti-liberal, unreal kind of a law.”
