Can’t use old notes to pay fines, says Delhi High Court

The Anti-Corruption court, while convicting the government servant, had imposed a fine on him and permitted him to deposit the money in old notes.

Old Rs 500 and Rs 1,000 notes cannot be used to pay court fines by litigants and convicts, the Delhi High Court has said. A bench of Justice Vipin Sanghi, in a judgment issued on December 9, directed a man convicted by a trial court on corruption charges to repay the Rs 75,000 fine that he had deposited in the treasury in demonetised currency.

The Anti-Corruption court, while convicting the government servant, had imposed a fine on him and permitted him to deposit the money in old notes. The HC, however, noted that since the RBI and the Centre had issued the notification for demonetisation, it was “beyond the judicial competence” of the special judge to “have enlarged the category of services and purposes for which demonetised notes could be offered as legal tender.”
