Earlier in the day, Indore jail authorities had refused to release Faruqui saying they had not received official communication from Chief Judicial Magistrate (CJM) Prayagraj, staying its earlier issued production warrant.
Speaking to The Indian Express, Superintendent of Indore Central Jail, Rajesh Bangde said, “We had earlier not received the order, however, a judge from the Supreme Court called up the Chief Judicial Magistrate of Indore and asked him to check the website for the uploaded orders and in case it was already uploaded, to comply by it. We checked the site and it was uploaded and hence he was released at 11 pm.”
A Supreme Court bench headed by Justice R F Nariman, while granting Munawar ad-interim bail in a case registered at Indore’s Tukoganj police station, had stayed the production warrant issued in connection with another case registered against the comedian in Uttar Pradesh’s George Town police station.
However, a day after the apex court’s order, officials from the Jail Department clarified that they had not received any official communication from CJM court in Prayagraj informing them about the stay to the production warrant. The apex court while staying staying the production warrant had said, “We issue notice in both petitions, and stay the judgment of the High Court. The petitioner is released on ad-interim bail on conditions to the satisfaction of the trial court. In the meantime, there shall be stay of the production warrants as well.”
Confirming his release, Faruqui’s cousin, Zaid Pathan said, “Faruqui was released an hour back and now we are taking him to Junagad. He is safe.”
Faruqui was arrested in Indore on January 1 following a complaint by Eklavya Singh Gaur, the son of BJP MLA Malini Singh Gaur and convenor of local outfit Hindu Rakshak, that the comedian allegedly hurt Hindu religious sentiments during a comedy show .
