What Delhi HC ruled in quashing NewsClick case on foreign funding, cheating

The first FIR against the online news portal was filed in 2020. Essentially, the state alleged that the company attempted to evade a law that did not exist when it received foreign funding.

In an order made public on Wednesday (June 10), the Delhi High Court quashed an FIR registered by the Economic Offences Wing (EOW) of Delhi Police and a money laundering case initiated by the Enforcement Directorate (ED) against NewsClick and its founder, Prabir Purkayastha.

Both proceedings stemmed from a 2020 complaint alleging that the media company had received Foreign Direct Investment through an artificially inflated share transaction to circumvent FDI limits on digital news media.

The ruling came nearly six years after the FIR was first registered. Justice Neena Bansal Krishna held that even accepting the state’s allegations in their entirety, the essential ingredients of the charged offences were not made out.
