Tribunal asks PMPML,others to pay Rs 1.29 lakh to accident victim

The Motor Accident Claims Tribunal (MACT) has ordered the Pune Mahanagar Parivahan Mahamandal Limited (PMPML) and others to pay Rs 1.29 lakh to engineer Pramod Khopde (22) who was injured in an accident in 2010. Khopde has problem walking after the accident.

On January 11,2010,Khopde,a third year mechanical engineering student suffered fractures to his left leg while boarding a PMPML bus. The Nigdi police arrested bus driver Ganesh Pol for rash and negligent driving.

Khopade spent Rs 55,242 on his medical treatment,out of which Rs 30,298 was reimbursed by PMPML,as his father is an employee of the public transport utility. Khopde,had moved the MACT demanding Rs 3 lakh from PMPML,bus owner M/s Butello & Sons,Ambegaon,and The United India Insurance Co Ltd. The bus is owned by M/s Butello & Sons and insured with The United India Insurance Co Ltd.

During the litigation process,PMPML denied that the accident took place due to negligence on part of the driver. “The driver is not under the PMPML service,but he was employed by the bus owner. As per the lease agreement,the bus owner is responsible for act done by his employee,” the PMPML submitted.

The bus owner did not appear before the tribunal. Whereas the insurance firm claimed that as the bus was in exclusive possession of PMPML,the public transport should compensate. The defence counsel argued that Khopde had stepped into a running bus from the front door,and the accident occurred due to his own negligence. But they did not examine any eyewitness to support these claims.

After hearing all the parties,MACT member and additional sessions judge,K D Vadane,ordered the PMPML,bus owner and the insurance firm to pay Rs 1.29 lakh with 7.5 per cent interest since filing of the petition in 2010 till its realisation. Khopde now works with a private firm.
