Nayana trial: Court pulls up defence lawyer for delay

Principal district and sessions judge Anant Badar on Wednesday admonished defence lawyer B A Aloor,who is representing two suspects in the gang-rape and murder case of software engineer Nayana Pujari,for adopting delay tactics in the case.

The judge lost his cool after Aloor filed a bail plea of suspect Mahesh Thakur. The judge said the plea was an attempt to delay the trial which will resume on June 7.

Aloor submitted the bail plea stating that there was no evidence against Thakur and cited that the polygraph and brain-mapping test reports filed against the suspects did not reveal anything. He also claimed the discharge plea filed by Thakur and suspect Vishwas Kadam was pending before the Bombay High Court. The court directed special public prosecutor Harshad Nimbalkar to reply to the bail plea on June 1 and reserved order till June 6. The judge said that Aloor was trying to protract the trial,while it was the court’s duty to commence the trial at the earliest as the suspects are under-trial prisoners lodged at the Yerawada central jail.

Aloor also verbally appealed to the court to first examine approver Rajesh Chaodhary to avoid recalling of the witnesses again for cross examination as the case was based on circumstantial evidence. The request was denied by the court,following objections raised by the prosecution,as it was the prosecution’s discretion to examine witnesses of their choice.

Meanwhile,Nimbalkar submitted trial programme comprising a list of 89 witnesses to be examined at the time of hearing. Nimbalkar will examine six witnesses each including the complainant and panchas on July 7 and 8.

Pujari was an employee of Synechron,a software company in Kharadi. She was found raped and murdered at the Zarewadi forest area at Rajgurunagar in Khed,around 50 km from Pune,on October 8,2010. The police had arrested Yogesh Raut (24),Rajesh Choudhary (23) and Mahesh Thakur (24),all from Khed,and Vishal Kadam (26) of Satara in connection with the offence. Choudhary has now turned approver in the case and his statement has been recorded in-camera in the court.
