Additional Sessions Judge V K Shewale on Friday sentenced two accused to life imprisonment in connection with the 2011 murder case. The court,however,acquitted two others giving them the benefit of doubt.
Shewale convicted Ramdas Baban Marne (38),a resident of of Marnewadi,and Raju Sahadu Shedge (42),a resident of Shedgewadi,for murdering Barku Chafaji Marne (67) on November 30 in 2011.
Paud police said there was a long-standing enmity between Marne and the accused over partition of their ancestral land that was registered in Marnes name.
On the day of the incident,the four intercepted Marne near Urawde chowk around 8 am. Shedge attacked him with a knife while Ramdas held him so that he could not retaliate. He was fatally injured on the head and neck. while Baban and Bharat Marne instigated the other two to kill the deceased, said the police.
According to additional public prosecutor Laxman Maindad,the oral dying declaration of the victim to wife Savitra Marne,who had rushed to the spot immediately after he was attacked and to whom he spoke last,turned out to be pivotal in proving the charges against the accused.
Savitra had testified that she rushed to the spot after hearing about the assault and found her husband lying in a pool of blood. She asked him about the incident and the deceased told her about the accused who had assaulted him, said Maindad. He added that the blood stains on the clothes of the two convicts also nailed them.
While giving the judgement,Shewale observed that due increased incidences of serious crimes in the Marnewadi area,independent witnesses were not coming forward. Two independent witnesses Balu Marne and Noor Mohammad had not supported prosecutions case during the trial. Deputy Superintendent of Police Vinayak Dhakne investigated the case. Constable Rajendra Sonawne assisted Dhakne in the investigation.
