The Bombay High Court on Friday granted bail to an engineer who had allegedly posted nude photographs of a woman on a social networking site before he left for higher studies in the US in 2009.
Swapnil Patole of Kolhapur was arrested on December 24,2011,at the Chhatrapati Shivaji International Airport on his arrival from the US for an offence that was registered against him in July 2009. Patole was booked under Sections of the IPC for administering a stupefying drug to the victim,extortion,criminal force for outraging a womans modesty,criminal intimidation and Sections of the Information Technology Act,2000.
The prosecution said Patole,who was friends with the victim in engineering college,had gone to meet her in Pune where she was pursuing a post-graduate course. He allegedly called her to his car and gave her a spiked soft drink.
According to the girls complaint,she was taken to a hotel room in a semi-conscious condition when Patole allegedly took nude photographs of her. The victim stated that he forced her to have sex with him but when she refused,he threatened to put her pictures on the Internet. He also allegedly demanded Rs 1.5 lakh from her and created a fake profile on Facebook where he posted the pictures . Patoles counsel Ashok Mundargi told the court the evidence in the case had been seized by the police and there was no question of tampering with the same. The bail plea said the girl was married and lived in Baroda,she could not be intimidated by the accused.
When the Cyber Crime Cell informed the court that the chemical analysis report would take at least three months to be made available,Justice R G Ketkar said Patole could not be kept in custody for so long and released him on bail of Rs 50,000.
