Two defence lawyers withdraw from 7/11 case

Two defence lawyers,representing four accused in the 2006 train blasts case,on Wednesday withdrew from the case before the special Maharashtra Control of Organised Crime Act court.

Two defence lawyers,representing four accused in the 2006 train blasts case,on Wednesday withdrew from the case before the special Maharashtra Control of Organised Crime Act (MCOCA) court. The move came after the four accused— Kamal Ansari,Mohammed Ali,Etheshyam Siddiqui and Mohammed Maji— sought to discontinue services of R B Mokashi and Khalid Azmi on grounds of ‘not being satisfied’ with their legal acumen.

Mokashi and Azmi submitted their withdrawal letters before special judge Y D Shinde stating that that the accused did not want them to continue with the case. Azmi said,“They were not happy with the way we were cross examining the witnesses and are were inclined to appoint a new lawyer so they had sought a ‘no objection’ from us,which we submitted today before the court.”

The prosecution has till now examined 32 witnesses in the case,most of them paanch witnesses. Special Public Prosecutor Raja Thackeray said,“The special court has directed the accused to appoint a new lawyer for themselves at the earliest and adjourned the hearing till August 10. The prosecution had kept three witnesses in the court for being examined,but since the withdrawal letters were submitted today,the court adjourned the proceedings till the next date,” he said.

The Jamiat-e-Ulema Hind,a Muslim organisation had appointed Mokashi and Azmi to represent the accused in court,after the Supreme Court had vacated the stay on the case. In 2007,the accused had similarly showed no confidence in their lawyers. Even the amicus curie appointed by the court,Rizwan Merchant,recently withdrew due to the adamant attitude of the accused. Mokashi said,“I have submitted all the evidence and documents to Jamiat and it is between the accused and Jamiat to decide on who they want to appoint next.”
