SHRC directs Thane Collector to pay compensation to man whose plot was acquired for govt project

He alleged that since he was not paid any compensation, he was left without any source of income following which he approached the MSHRC.

The Maharashtra State Human Rights Commission (MSHRC) last month directed the Thane Collector to pay compensation to a Kurla resident whose plot was allegedly acquired for a government project but was not paid compensation. The order was made available on Thursday.

The complainant, Mohd Shaikh, approached the commission stating that his property bearing Plot No. 111 at Mauje Balyani in Kalyan Taluka comprising his house and shop were taken up for the Mumbai–Vadodara Ramay Alignment.

He alleged that since he was not paid any compensation, he was left without any source of income following which he approached the MSHRC.

The commission in its order by chairperson Justice AM Badar mentioned that it had earlier asked the collector to conduct a fact-finding inquiry into the matter and submit a report. The order mentioned that the collector neither carried out the inquiry nor appeared before the commission.

The commission mentioned that in the instant case in absence of rebuttal by the Collector, Thane to the averment made in the complaint it needs to be held that property of the complainant is compulsory acquired by the state without payment of any compensation. The order further mentioned that it needs to be ordered to the Collector, Thane to pay fair compensation to the complainant as per the existing law viz. The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013.
