Bollywood actor Salman Khan on Monday pleaded for a fresh trial before a sessions court in the 2002 hit-and-run case,saying the court should discard the evidence adduced earlier before a magistrate as he was now facing a more serious charge of culpable homicide not amounting to murder.
Salmans lawyer Srikant Shivade argued that the actor had not been given an opportunity in the magistrates court to cross-examine witnesses vis-a-vis the additional charge of culpable homicide that was imposed on him recently.
The prosecution,however,opposed Salmans plea saying this was an attempt to delay the trial. The magistrate had adduced evidence on the basis of the deposition given by the witnesses and hence,this evidence could not be discarded,the public prosecutor argued.

Earlier this year,a sessions court had framed charges against Salman for culpable homicide,the maximum sentence for which may go upto 10 years of imprisonment.
