Pune land scam: Nayyar affidavit led to CBI action

Within two days after the CBI raided the residences of Lt Gen Noble Thamburaj and S R Nayyar,it has come to light that what triggered the action by the investigating agency is an affidavit filed by Nayyar in the Bombay High Court in September 2006 in connection with a dispute about a land on Lothian Road in Pune Camp.

Within two days after the CBI raided the residences of Lt Gen (retd) Noble Thamburaj and S R Nayyar,it has come to light that what triggered the action by the investigating agency is an affidavit filed by Nayyar in the Bombay High Court in September 2006 in connection with a dispute about a land on Lothian Road in Pune Camp. To the investigators,this affidavit brought back the matter into litigation in spite of previous court judgments in favour of the Army till 2005.

“Later,an out-of-court settlement was struck when Thamburaj was the Southern Command chief. We need to find out in what circumstances did Thamburaj give these orders and whether he was supposed to get the Ministry of Defence’s nod before going forward with this move. If he was supposed to,then did he get in touch with the Centre?” said a CBI officer.

The CBI ACB had registered the case after a primary inquiry into the complaint was received from the additional director-general (discipline and vigilance),MoD,the CBI had said. Vidya Kulkarni,superintendent of police (SP) with CBI ACB,said,“We will obtain the said affidavit from the HC.”

Deputy SP Rajpal Singh,the investigating officer for the case,said,“We will check the lockers of these people in the course of investigation.” Both Kulkarni and Singh refused to comment further,saying that the investigation was on.
