A special court on Tuesday sent two men arrested in connection with the ISIS Pune module case to further custody of the National Investigation Agency (NIA) till June 2. During the remand in court, accused Talha Liyakat Khan alleged physical and mental torture in custody. The court, however, said the medical reports do not show any such proof and sent him to further custody.

Khan and Abdulla Faiyaz Shaikh alias Daiperwala were arrested on May 16, with the NIA claiming they were intercepted by the Bureau of Immigration at the Mumbai International Airport Terminal 2, when they tried to return to India from Jakarta, Indonesia.

On Tuesday, NIA lawyer Sagar Bhandare submitted that the agency wants to probe further the multiple email IDs used by the accused for communication with duplicate mobile numbers. He also submitted that the accused have to be confronted with suspicious bank transactions. On Khan’s allegations of torture, the NIA claimed he was taken for medical examination regularly and showed the court medical reports from six examinations between May 17-May 26.

The court said that in the reports there is nothing to show the alleged torture, nor had the accused raised any complaint during his medical examination. Tahera Qureshi, lawyer for the accused, said the men had lawfully left the country in 2022 and were in Oman, when they were named as wanted accused in 2023 in the ISIS case, following which they were made to leave Oman. They then left for Iran, from where too, they were made to leave in March this year and hence went to Indonesia, from where they were detained and brought to India.

In 2023, the agency had claimed its probe had led them to a module of banned terrorist organisation ISIS, where the accused conspired to commit terrorist acts to disturb communal harmony in the country. The agency has previously filed a chargesheet against 10 accused under various sections of the Unlawful Activities (Prevention) Act, Explosive Substances Act, Arms Act, and the Indian Penal Code.
