The Bombay High Court on Thursday set aside a 2016 notification that had proposed the construction of residential and commercial projects on land near the proposed international airport in Navi Mumbai.
The October 2016 notification was in respect to three land pockets in Karave village in Seawoods, described as pockets A, B and D. The notification had sought the removal the three pockets from the No Development Zone in the sanctioned Development Plan and to put first two pockets in the Regional Park Zone.
The reason for the proposed change in pocket A was to facilitate the development of a golf course.
The court, while hearing a petition by Navi Mumbai Environment Preservation challenging the notification, said: “We hold that even assuming that the impugned notification is legal and valid, the reservations provided therein cannot be implemented for the reasons recorded by us and, therefore, CIDCO and the Project Proponent shall not proceed with the work of making golf course and construction of residential complex on pocket A and D.”
The court also directed the CIDCO to preserve the lakes of Navi Mumbai. It named two particular, one behind Delhi Public School and another near Indian Maritime University.
