Mumbai News Live Updates: Bhagwat is not Constitution maker, says Raut on `true independence' comment

Shiv Sena (UBT) MP Sanjay Raut on Tuesday took exception to RSS chief Mohan Bhagwat's statement that India's "true independence" was established when the Ram temple in Ayodhya was consecrated.

The Rashtriya Swayamsevak Sangh chief was not the maker of the Constitution, he said, adding that Lord Ram should not be used for political gains.

He was reacting to the Sangh chief's comment that the true independence of India, which suffered foreign invasions for centuries, was established when the Ram temple was consecrated in Ayodhya last year.

"The RSS chief is a respected individual, but he is not the maker of the Constitution. He does not draft or alter the laws of this country. The consecration of Ram Lalla is indeed a moment of pride for the country and everyone has contributed to the construction of the temple. But to claim that the country became independent only now is incorrect," Raut told reporters here.

India gained independence in 1947, the Rajya Sabha member said, adding that Lord Ram should not be politicised.PTI

NCP (SP) dismisses reports of demand for Jayant Patil's ouster as Maharashtra party head

The NCP (SP) on Monday dismissed as "baseless" reports about the demand for replacement of its Maharashtra unit head Jayant Patil, in view of the party's dismal performance in the state assembly polls last year.

NCP (SP) state spokesperson Pravin Kunte claimed such reports in a section of media were aimed at maligning Patil's image.

Mumbai News Live Updates: Badlapur school sexual assault victims very young, trial should be fast-tracked: HC

The Bombay High Court on Monday said the trial in the last year's Badlapur school sexual assault case should be fast-tracked and conducted expeditiously as the victim girls are very young.

In August last year, a male attendant sexually assaulted the two girls - aged four and five - inside the toilet of their school located in Badlapur area of Maharashtra's Thane district.

He was arrested and later killed in a shootout with police when he was being taken from jail for questioning. The Special Investigation (SIT), set up by the Maharashtra government to conduct a probe into the case, has filed its chargesheet.

The chargesheet was filed against the attendant, the school's headmaster and two members of its management for "failing to report" the sexual assault, as required under provisions of the Protection of Children from Sexual Offences (POCSO) Act.

The high court took suo motu (on its own) cognisance of the incident after it came to light that the local Badlapur police had not taken prompt action to lodge an FIR in the case. On Monday, public prosecutor Hiten Venegaonkar informed the bench of Justices Revati Mohite Dere and Neela Gokhale that the probe into the case was over, chargesheet filed and now trial would be held.

The court then emphasised the need to keep the trial fast-tracked. "The case will have to be fast-tracked and conducted expeditiously as the victim girls are of a very young age," the court said. - PTI

Mumbai News Live Updates: Ahead of local polls, Sena's Sanjay Raut says, 'No alliance can succeed if dialogue stops'

Days after the Shiv Sena (UBT) announced to go solo in the local body polls in Maharashtra, party leader Sanjay Raut on Monday said no alliance can succeed if dialogue among its partners ceases.

To maintain communication among partners, "responsible leaders" need to be appointed, and the Congress, which is the largest constituent of the opposition INDIA bloc, must take on this role, Raut told reporters here.

He also said there was nothing wrong in contesting elections against coalition partners, but in such cases, no party should dub their former or potential future allies as "traitors".

On Monday, while speaking about the INDIA bloc, Raut said, "It is the collective desire of all of us to progress further in the political landscape of this country. However, over the past few days, some of our alliance partners seem to have taken the stance that communication has broken down. No alliance can succeed if dialogue is severed." He claimed the Shiv Sena-BJP alliance collapsed in 2019 because dialogue between the two ceased.

"Lack of proper communication and dialogue directly contributed to the alliance's breakup," he said.

The INDIA bloc consists of nearly 30 parties and to maintain dialogue with all of them, it is essential to appoint some responsible leaders, Raut said.

The contractual employees of a private operator hired by the Brihanmumbai Electric Supply and Transport undertaking went on a flash strike at one of the depots in Mumbai early Monday morning, partially affecting the BEST bus services.

While BEST did not disclose the reason for the strike, sources said it was triggered by the alleged mistreatment of a pregnant woman conductor by officials of the private operator.

An additional commissioner of the Brihanmumbai Municipal Corporation (BMC) is currently holding charge of the position.

He also said the strike was limited to the Pratiksha Nagar depot, and bus operations at the other BEST depots were unaffected.

BEST employees union leader Suhas Samant said Mateshwari operates 110 buses from the Pratiksha Nagar depot, and none of them were running since the strike began in the morning

Mumbai News Live Updates: Sharad Pawar's long-term politics of betrayal ended by BJP's poll victory in Maharashtra says Amit Shah

Union Home Minister Amit Shah on Sunday said veteran politician Sharad Pawar played politics of betrayal and treachery in Maharashtra from 1978, which was ended by BJP's massive victory in the assembly polls with its resolve to establish a stable government.

Addressing a state BJP convention in Shirdi, Shah said the people of Maharashtra showed Pawar, who heads NCP (SP), and Shiv Sena (UBT) leader Uddhav Thackeray their place by rejecting the politics of dynasty and betrayal in last year's elections.

Citing differences between Congress and allies in Delhi, West Bengal, Bihar, and Maharashtra, Shah said the decline of the opposition INDI block has begun.

"Sharad Pawar started politics of 'daga-phatka' (betrayal and treachery) in Maharashtra in 1978, which was rejected by people in 2024 (elections). Mumbai News Live Updates: Uddhav's strength has diminished, says Rane on Sena (UBT) announcing to go solo in local body polls

BJP MP Narayan Rane on Sunday slammed Shiv Sena (UBT) chief Uddhav Thackeray over the party's announcement about contesting the local bodies elections solo, alleging that the latter's strength had diminished.

The Shiv Sena (UBT) on Saturday announced to contest local bodies polls solo, raising a question mark over the opposition Maha Vikas Aghadi's unity. Party leader Sanjay Raut cited the lack of opportunities for workers of respective parties in an alliance and the right to organisational growth as the considerations for contesting solo.

Raut said the INDIA bloc and MVA alliances — comprising Sena (UBT), Congress, and NCP (SP) — were meant for the Lok Sabha and state assembly elections.

Reacting to the development, Rane said, "Uddhav Thackeray once spoke with confidence, but now his strength has diminished. What will happen if they contest alone? The party no longer has the capability. In two and a half years, he has lost what was achieved under Balasaheb Thackeray in 46 years." The announcement of the Shiv Sena (UBT) to go solo in local body elections comes amid rumours that the party is softening its criticism of the BJP and Fadnavis' "anything can happen in politics" remark.

Asked about perception of growing closeness between the Sena (UBT) and BJP, the former union minister said, "I am unaware of it. It feels fine to me. Senior leaders will make a decision on this, and we will accept it." He also refused to comment on whether the BJP would contest the local body elections independently.

Rane further hit out at Sena (UBT) MP Raut over his allegation that Chief Minister Devendra Fadnavis was protecting the main accused in the Santosh Deshmukh murder case and the state government was safeguarding the mafia.

He said, "When the Shiv Sena was in power, who was Raut protecting? Which mafia did he meet? What good deed landed him in prison? He should explain this first. The Shiv Sena (UBT) lacks credible voices, which is why Raut makes such statements." Asked about Deputy Chief Minister Eknath Shinde's alleged displeasure over not getting another term as CM, Rane said, "Shinde did commendable work during his tenure. Since the BJP has more MLAs this time, the chief minister was from the party. Shinde cannot be upset as he is also a politician." - PTI

Mumbai News Live Updates: Probe agencies left red-faced with court orders on 'illegal' arrests

A series of court orders here recently directing for the release of accused citing "illegal arrest" have come as a setback for probe agencies, with prosecution lawyers calling for a balanced approach while defence counsels insist on following norms.

In most of these cases, the arrests were without "application of mind," a defence counsel claimed, while the prosecution lawyers batted for victims' rights.

In December 2024, the Central Bureau of Investigation arrested six persons, including two IRS officers, in a bribery case, but a special court here denied the CBI custody of the accused after finding their arrest as "illegal" and ordered their immediate release.

Over the last six months, several remand pleas of probe agencies, such as CBI, Enforcement Directorate (ED) and local police, in courts here have met the same fate.

In most cases, the defence's submission was centred around the probe agencies not following the Bharatiya Nagarik Suraksha Sanhita provisions, like not maintaining case diary properly, not providing the ground of arrest to the accused immediately or not producing him in court within 24 hours of the arrest.

Speaking to PTI, advocate Rahul Agarwal, who has appeared for a few accused persons, claimed, "They (investigation agencies) are not following provisions laid down in the law and guidelines set by the apex court and high courts in letter and spirit."

"The Supreme Court's guidelines clearly state that there needs to be a physical ground of arrest given to the accused or the arrest will be declared illegal," he said.

In the bribery matter against IRS officers, the special CBI court noted the case diary had loose sheets of papers, which amounts to contravention of the provisions of law, as per a ruling of the Bombay High Court ruling.

The court said it is necessary for the investigation officer to ensure all case papers are maintained properly.

In another jolt to the CBI, the court refused it the transit remand of ED officer Vishal Deep arrested in a bribery case, noting "the prosecution's failure to produce the case diary shakes its case".

The court held it as a "serious lapse" while rendering the arrest illegal.

The ED was also left embarrassed last year when a special PMLA court set free businessman Purushottam Mandhana, accused in a money laundering case, for not providing the ground of arrest and copy of "reasons to believe" that he is guilty of the offence.

Local police have also faced rejection of their remand pleas by courts on accounts of arrest not being proper.

A magistrate court here recently ordered the release of a man booked for allegedly posting online a manipulated video of Chief Minister Devendra Fadnavis's recent speech on Naxalism.

In a solace for police, a sessions court last month came down heavily on a magistrate for taking a "hyper technical view" while declaring the arrest of rape accused film producer Gunwant Jain as "illegal", as the police were late by just four minutes in communicating the ground of arrest to the accused.

The sessions court ordered the accused to surrender before police.

Senior advocate Satish Maneshinde said in most of these cases the arrests were "mechanical" without "application of mind".

"The police officers do not have enough knowledge or they don't apply their mind, so with those non-compliances, the prosecution was violating the principle of natural justice and fundamental rights," he added.

However, batting for a balanced approach, lawyers representing the state are of the opinion that victims' rights are equally important.

Why should a victim suffer if the investigation agencies have made a mistake? they asked.

Senior special prosecutor Ujjwal Nikam, who has represented the state in various high profile cases including the 1993 Mumbai bomb blasts case, vouched for a balanced approach and said probe agencies should also get an opportunity for custodial interrogation of the accused.

"No doubt it is mandatory that the grounds of arrest be informed to the accused and their family too, so that the personal liberty of the accused is not jeopardised," Nikam said.

It's time for some amendment in the said provision because some hard nuts (accused) are very difficult to crack and their custodial interrogation is necessary, which does not mean ill-treatment, but asking constant questions, he added.

Special Public Prosecutor Shishir Hire batted for victims' rights.

" If an accused is absconding, he is aware that police are running behind him and he knows the reason for his arrest also, so you cannot apply these routine parameters to the absconding accused," he said.

"There is also the concept of victimology...the police make a mistake...you will give its benefits to the accused, what about the victim? We need to be concerned about the victim...victimology is a new brand that is emerging and that is more important than the accused," he added.

Advocate Jitendra Sharma, who has represented the CBI in several cases, said if such cases are decided by the judiciary, then how will an investigation agency proceed with the probe in matters of "collusive corruption", where private and public servants are "hand-in-glove".

"Arrest is illegal or legal, it is the prerogative of the judiciary. Simultaneously, the probe agency also has to conduct the investigation in a fair manner and that chance should be provided by it, otherwise it will create a bottleneck in the investigation," he added. - PTI

Mumbai News Live Updates: BJP to focus on strategies for local body polls at Shirdi meet; Shah to attend

The Maharashtra BJP's convention in Shirdi on Sunday, to be attended by Union minister Amit Shah, is expected to fine-tune its strategies for the local body polls, building on its impressive show in the 2024 state assembly polls.

The state-level convention is the BJP's first major gathering since its win in the November 2024 assembly polls and formation of government under its leader Devendra Fadnavis.

Senior BJP leader Shah is expected to address the party workers during the event, at the Shirdi temple town in Ahilyanagar district, which is likely to see the participation of nearly 15,000 delegates.

The BJP has now shifted focus on the local body polls, including in Mumbai, and the convention is aimed at formulating strategies for them, a party functionary said.

The convention will focus on strengthening the party's position in 27 municipal corporations by discussing strategies, addressing ground-level challenges, and planning organisational changes, he said.

Speaking to reporters on Saturday evening, Chief Minister Devendra Fadnavis said, "This convention is about expressing our gratitude towards the party functionaries and workers. We will also get a new task for our party workers." Fadnavis is set to meet district party leaders, state office-bearers, newly elected legislators and ministers to discuss strategies and plans for the elections.

Maharashtra BJP president Chandrashekhar Bawankule will open the event proceedings and Fadnavis will propose a resolution thanking the people of the state for their support in the assembly elections, a party functionary said.

Amit Shah will also address the event.

A youth-focused campaign, inspired by the philosophy of Swami Vivekananda, will be launched to coincide with the National Youth Day, celebrated on January 12 every year in commemoration of the spiritual leader, sources said. - PTI

Mumbai News Live Updates: Sena (UBT) never called for disbanding INDIA bloc or MVA: Sanjay Raut

Shiv Sena (UBT) leader Sanjay Raut on Sunday said his party wants to go solo in the local bodies polls to strengthen its base and has never called for dissolution of the opposition INDIA bloc or the Maha Vikas Aghadi (MVA).

Raut's remarks came a day after he cited the lack of opportunities for workers of respective parties in an alliance and the right to organisational growth as the major considerations for contesting solo, which raised a question mark over the opposition bloc's unity.

Speaking to reporters on Sunday, Raut said, "The MVA was formed for the assembly polls and INDIA bloc for the Lok Sabha elections. The local body elections are meant to empower party workers and strengthen the organisation at the grassroots level." "I or my party have never said that the INDIA bloc or the MVA should be dissolved," the Rajya Sabha member added.

The INDIA bloc and MVA alliances include the Uddhav Thackeray-led Shiv Sena (UBT), Congress, and Sharad Pawar's NCP (SP).

Asked about the Congress leaders criticising him over comments regarding plans to go alone in the polls, Raut said the grand old party's members should listen to his full comments before reacting.

"The Congress leaders should have the habit of listening to others," he said.

Raut said the Shiv Sena (UBT) wants to ensure its 'flaming torch' (poll) symbol reaches voters at the grassroot level.

The MVA allies should now work at the booth-level to strengthen its parties and their workers, he said.

"We have time as there are four-and-a-half years for the next Lok Sabha and Maharashtra assembly elections," the Sena (UBT) leader said.

Asked about NCP (SP) head Sharad Pawar's discussion with Chief Minister Devendra Fadnavis on bringing peace in Beed and Parbhani, Raut said Maharashtra is stunned after the assembly poll results.

"Peace cannot come by giving protection to the killers of sarpanch Santosh Deshmukh and Somnath Suryavanshi," he said.

The brutal murder of Santosh Deshmukh, the sarpanch of Massajog village in Beed district, on December 9 has triggered a slugfest between the ruling and opposition parties as one of the persons held in a related extortion case is a close associate of state minister Dhananjay Munde.

The incident has led to widespread protests in the state and also given rise to fears of a caste conflict since Deshmukh was a Maratha and some of those held hail from the Vanjari community.

Somnath Suryavanshi, who was arrested following violence in Parbhani on December 10 after a replica of the Constitution was vandalised, died on December 15 after he was rushed to a hospital from jail following sudden illness.

The ruling Mahayuti alliance of BJP, Shiv Sena and NCP won 230 of the state's 288 seats in the November 2024 assembly polls, shrinking MVA's tally to 46 seats, with Sena (UBT), Congress, and NCP (SP) each contributing 20, 16 and 10 seats, respectively. - PTI

Mumbai News Live Updates: Amit Shah to address state BJP executive meet at Shirdi today

Union ministers Amit Shah and Nitin Gadkari along with Chief Minister Devendra Fadnavis will address thousands of delegates who are set to attend the state BJP executive meeting at Shirdi on Sunday. This is the first state executive meet after the BJP’s landslide victory in the Maharashtra Assembly elections in November last year. The state executive meet will have 15,000 delegates from across Maharashtra including all elected BJP MPs, MLAs, office bearers, district chiefs and karyakartas, BJP minister Chandrashekhar Bawankule said on Saturday.

The BJP chose January 12 as it marks the birthday of Swami Vivekananda. “The party’s objective is to connect with youths and entrust them a greater role in the organisation,” Bawankule said.

On Saturday, Fadnavis will convene a meeting with party leaders and office bearers at Shirdi. The party is likely to adopt a resolution to felicitate Fadnavis at the meeting.

Apart from celebrating the BJP’s performance in the Assembly elections, the party leadership will reflect on the challenges ahead, both at the organisational as well government levels. Greater coordination between the party and the organisation will be discussed and certain directives will also be given to the party cadre as elections to local bodies, including the Brihanmumbai Municipal Corporation, are likely to be held soon, sources said.

Shah, who held meetings region-wise to boost the morale of the party cadre ahead of the Assembly elections, will address the delegates along with Gadkari. The day-long session will also see Fadnavis outlining the detailed roadmap for the party.

Mumbai News Live Updates: Sharad Pawar discusses Beed, Parbhani situation with CM Fadnavis

NCP head Sharad Pawar has said he has spoken to Maharashtra Chief Minister Devendra Fadnavis on efforts to normalise the social tension gripping Beed and Parbhani after the murder of a sarpanch and death of a Dalit youth in judicial custody.

United efforts are required to restore normalcy and resolve issues in Beed and Parbhani, Pawar said on Saturday.

Speaking at an event here, Pawar cited his experience as chief minister in dealing with the devastating Latur earthquake, in which more than 10,000 persons died in 1993 and the serial blasts in Mumbai the same year.

The people of Maharashtra were socially aware and always stood united and cooperated with the administration in crises, the former Union minister pointed out.

"It requires a united effort to restore normalcy and a chief minister cannot do it alone. I held a detailed discussion with CM Fadnavis today over the prevailing situation in Beed and Parbhani after these incidents. Most of my time these days is devoted on how to normalise the situation and resolve issues in Beed and Parbhani," Pawar said.

"People who lived harmoniously are now living in fear and have developed animosity for one another. I spoke to the CM. We may have political differences but come what may, we have to work to keep people united," he asserted. - PTI
