The medical tests on the 12-year-old Saki Naka girl, who has alleged rape by nine men over two years, have found no evidence of rape or sexual assault, the police said on Thursday.
The medical report is only a part of the investigation and we have other aspects that remain to be enquired into. After studying the medical report in detail,we will be sending the girl for a second medical check-up preferably to a lady gynecologist. We will also send her to a psychiatrist to assess if she is under trauma or is fabricating things, said senior police inspector S R Dhanedhar of the Saki Naka police station.
While the first medical report detected an intact hymen and found no injuries on the girls body, she has stuck to her complaint alleging rape, the investigating officials said. We also have to verify the victims exact age. Though her aunt claims that she is 12,the doctors at the Nagpada police hospital, who performed the medical examination on her,had stated her age to be around 13-14 years. We intend to send her for another detailed medical examination for a second opinion which will help clear several things, said Dhanedhar.
The girl was on Thursday sent to JJ Hospital for a second medical check, the police said.
Stressing that no innocent will be arrested, senior police officials said the investigation into the alleged rape would continue on the basis of the girls complaint. Why would a 12-year-old girl accuse nine men of raping her and why will a mother accuse her own son of the same crime? If the accused were innocent, they should have turned themselves in by now. But even after three days of filing the complaint, they are still absconding, said a police official working on the case.
Our job is to collect the evidence and submit it to the court. Whether the sections in the case have to be changed from rape to attempt to rape or molestation, that depends on the court. Even if the complainant wishes to withdraw from the case at this stage, she would have to approach court, he added.
Meanwhile, the family of 71-year-old Jamuna Prasad Sharma, arrested in the case along with three others, alleged that it was a conspiracy by the girls aunt against them. We own over seven shops in the area that we have leased out and the girls family stayed opposite those shops. She had offered to enter into a partnership with us but we had refused. We are shocked that she can take her grudge so far, said Sharmas daughter-in-law.
Dhanedhar, however, refused to comment on these allegations and said that only the arrest of Dhaval, the girls cousin who allegedly raped her for the first time, will give a clearer picture of the case.
