An official from the Anti-Narcotics Cell of the Mumbai Police said that during an operation carried out by the unit, one Surajkumar Ramvilas Prajapati (29), a Goregaon (W) resident, was found to be involved in drug smuggling.Making use of the special PITNDPS Act in their fight against repeat drug offenders, the Mumbai Police on Saturday sent a 29-year-old drug smuggler with repeated offences to Kolhapur prison for a year.
The PITNDPS Act, 1988, provides for the issuance of preventive detention orders against any person with a view to preventing him from engaging in illicit trafficking of narcotic drugs and psychotropic substances.
An official from the Anti-Narcotics Cell of the Mumbai Police said that during an operation carried out by the unit, one Surajkumar Ramvilas Prajapati (29), a Goregaon (W) resident, was found to be involved in drug smuggling.
It was later found that a total of seven cases of ganja smuggling had been registered against him under the NDPS Act. A charge sheet was filed in court and he was convicted. Prajapati was, however, later released on bail in the said crime.
An official said it was observed that every time he was released on bail, he would return to supplying drugs. Keeping this in mind, a proposal was submitted to the Principal Secretary, Home Department, Government of Maharashtra, for the issuance of a restraining order against him under the Narcotic Drugs and Psychotropic Substances (Prohibition of Unlawful Traffic) Act, 1988 (PIT NDPS Act) by the Anti-Narcotics Cell, Kandivali Unit.
“Since it leads to detention of a person for a year, the proposal has to be accepted by no one less than the Home Department Secretary,” an official explained. The official added that the detention proposal was approved by the Home Department, Government of Maharashtra.
Accordingly, Prajapati was taken into custody and a detention order was issued against him. He was sent to Kalamba Central Jail, Kolhapur, for one year on December 6.
