Juhu ‘rave’ bust: Court grants immunity to four accused

A special Narcotics Drugs and Psychotropic Substances (NDPS) Act court Monday granted immunity to four persons who were booked for consuming drugs at an alleged rave party arranged at Juhu’s Oakwood Premier Hotel in May last year.

In April,the four accused – Mohammad Hussain Kooler Zadeh (24),Sneha Talreja (24),Yuvraj Bhalla (29) and Karan Chawla (30) – had submitted certificates of detox treatment,ranging from a few weeks to several months,that they underwent at the state’s King Edward Memorial (KEM) hospital.

On Monday,the court accepted their applications and granted them immunity against prosecution.

The application was moved under section 64A of the NDPS Act,which states that any addict charged with offences involving small quantities of narcotics,who “voluntarily seeks to undergo medical treatment for de-addiction” from a hospital recognised by the government,can be given immunity from prosecution.

While passing the order,Special NDPS judge I M Bohari has laid down a condition that the immunity would be provided only till the time the accused do not indulge in any substance abuse or related crime. “Subject to condition that they would be liable for prosecution in this case,if in future they are found consuming narcotic drugs and psychotropic substances,” the order reads.

As many as 86 people were booked for consuming drugs and a chargesheet filed against them early this year. A few of the accused,including the party organiser Vishay Handa,were also booked under several sections of the NDPS for possession of narcotics.

The police had seized 110 gm of cocaine and 64 gm of charas during the raid. The blood and urine samples of around 91 people were sent to hospitals for tests on drug and alcohol consumption,of which around 80 tested positive.

According to the prosecution’s case,a raid was conducted on May 20,2012,at the Oakwood Premier Hotel in Juhu.

Patrons who tested positive were booked for illegal possession of small quantity of narcotics for personal consumption (Section 27 of NDPS Act). The police had recovered 110 grams of cocaine,64 grams of cannabis and popular party drug MDMA aka Sizzler.
