Naval Officer Emile Jerome,convicted for culpable homicide not amounting to murder in the killing of TV executive Neeraj Grover in 2008,on Wednesday withdrew his bail application,after the Bombay High Court indicated that it was not likely to release him on bail.
Stating that he had already served half of the 10-year imprisonment sentence handed out to him by the trial court,Jerome had pleaded that he should be enlarged on bail,while his appeal against conviction is pending before the High Court.
Additional Public Prosecutor Mankunwar Deshmukh,however,cited a Supreme Court ruling which stated that grant of bail was not routine in cases where the accused had served half the sentence while his appeal was pending. She added that the state had filed an appeal against the trial court’s decision acquitting Jerome and his friend,Kannada actor Maria Susairaj,of the murder charge,and sought the enhancement of the punishment handed out to Jerome. She said there was sufficient material to prove that Jerome had murdered Grover in Susairaj’s Malad flat.
Seeking the reversal of the trial court order that held him guilty of culpable homicide not amounting to murder,Jerome said,“That motive,if any,was with the original accused No 1 (Susairaj) for committing the offence and not with the appellant/original accused No 2 (Jerome).”
