Disha Salian death: Bombay HC seeks Maharashtra govt reply to father’s plea for fresh probe

The Bombay High Court on Wednesday directed the Maharashtra government to respond to a petition filed by the father of Disha Salian, who was a former manager of Bollywood actor Sushant Singh Rajput, seeking a fresh investigation into his daughter’s death.

Disha Salian, 28, allegedly died by suicide on June 8, 2020, in suburban Malad, six days before Rajput did so at his Bandra home.

Public Prosecutor Hiten Venegaonkar submitted before a bench of Justices Sarang V Kotwal and Shriram M Modak that a “direct relative” of Disha had now filed the petition at a time when one round of inquiry had been over and a closure report filed in the matter. “We are required to go into all this,” he said.

Venegaonkar sought permission to file an affidavit in reply to the petition filed by Satish Salian and the court asked the government to do so within four weeks.

The division bench posted the matter for further consideration on June 15, noting that it was difficult to take it up before the summer vacation. The court also granted liberty to the petitioner to approach the vacation bench in case of urgency.

In his plea, Satish Salian claimed that he initially believed that the investigation was genuine but later found it to be a cover-up.

On April 2, Satish Salian submitted in the high court that considering the reliefs he sought, the matter pertained to a bench of Justice Kotwal. A bench led by Justice Revati Mohite-Dere then asked the court registry to assign an appropriate bench for his petition.

Satish Salian has sought a direction for the Mumbai police to register an FIR based on a complaint lodged by activist and lawyer Rashid Khan Pathan in January 2024 against Shiv Sena (UBT) MLA Aaditya Thackeray. He has also sought a CBI investigation into the matter.

Satish Salian has further sought that his writ petition be tagged with a PIL plea filed by Rashid Khan Pathan, who claimed to be president of the Supreme Court & High Court Litigants Association of India, seeking a direction for the CBI to investigate Thackeray in connection with the deaths of Rajput and Disha.

In October 2024, Thackeray filed a caveat in the high court seeking to be heard before any order is passed on Pathan’s petition. He also stated that Pathan’s petition was non-maintainable, arguing the CBI was already investigating the Rajput case, the Supreme Court was seized of the matter, and that the high court could pass no order in this regard.

Thackeray’s lawyer then submitted that nothing had been found against the Sena (UBT) MLA in an investigation carried out by the local police and the Criminal Investigation Department.
