The Bombay High Court has issued showcause notices to directors of Kalpataru (Indo-Saigon) Constructions asking why contempt proceedings should not be initiated against them for giving false statements in court to get a favourable order. A fine of Rs 25,000 has also been imposed.
Two petitioners in the 24-year-old case had died during the course of proceedings and their heirs have been brought on record. The petitioners Ladharam and Sundri Ahuja had sought possession of three Koliwada shops.
In 2003,a civil court had directed builders to give possession of shops to petitioners on payment of Rs 2,40,000,with an additional amount of Rs 50,000 for each shop.
Justice Sondurbaldota issued the notice over a false statement given by builders in August 2008 in a bid to procure interim relief. They had,during the period of stay they obtained,informed the court that the constructions measuring 996 sq ft meant for petitioners had been completed and would be reserved for them. The petitioners,however,found that there were no constructions in the area.
The court had appointed a commissioner to visit the site and based on his report,petitioners advocate Sanjiv Sawant informed the court that the claims were false.
