A sessions court Tuesday convicted a 22-year-old man and sentenced him to ten years of imprisonment, for raping a minor in Mulund in 2012.
The judge, A S Shende, had found Rafiq Mohammed Sheikh guilty under sections 376 (Punishment for rape), 506 (Punishment for criminal intimidation) and 417(Punishment for cheating) of the Indian Penal Code.
According to the 16-year-old victim’s deposition, Sheikh, the victim’s neighbour, had seen her at an event, couple of days after which, he forced her to meet him in an isolated area in Bhandup on September 12, 2012. Sheikh claimed to be in love with her and promised to marry her and asked her to have a sexual relationship with him, the victim told the court.
Moreover, Sheikh started calling her incessantly and she tried to avoid his calls, said the victim in the deposition. Sheikh then forced her to meet him, two more times in the future. However, on September 27, 2012 the victim’s mother had seen Sheikh and the victim together inside a rickshaw, to which Sheikh reacted by running away from the spot. Upon being questioned, the victim disclosed to her mother that Sheikh had threatened to kill her if she told to anyone about their illicit relationship.
The parents of the victim then lodged a complaint of rape with the Bhandup police station. The defence claimed that the relationship they shared was with the victim’s consent. In her deposition, however, the vitim said, “It is wrong to say that I have falsely implicated Rafiq on the say of my family members.”
The public prosecutor, Kalpana Hire said “Sheikh was convicted based on the statements of the victim’s mother and the medical reports indicated that her hymen was torn.”
