Bombay High Court (HC) stayed Tuesday until further orders construction of a sugar factory headed by wife of state minister for cooperatives Harshavardhan Patil,Bhagyashri.
Grampanchayat Ashti has moved HC opposing the factory in Solapur district.
Lawyer for the petitioner S S Patwardhan contended Tuesday while seeking environmental clearance for the project a certain plot was shown, while the factory was being built on another.
He also argued the construction was against provisions of Maharashtra Land Revenue Code (MLRC),which says agricultural land cannot be used for non-agricultural purposes. The gram panchayat also claimed it had refused permission to the factory as it may cause air and noise pollution threatening migratory birds.
Patwardhan said the factory would release industrial effluents into nearby Ashti reservoir, located about 1.5 km from the actual construction site, which was the source of water for about 25 villages.
HC adjourned the case till April 30.
