The UP government has decided to enact the Uttar Pradesh Industrial Services Guarantee Act to ensure delivery of various services to industries in a given time-frame.
At a meeting presided over by Chief Secretary Jawed Usmani on Monday,it was decided that in the first phase 14 services of seven departments will be covered. These departments are Directorate of Industries,Electrical Safety,Fire Safety,Power,Pollution Control,Labour and Factories. It was decided in the meeting that maximum of Rs 50,000 penalty would be imposed on officers in cases of delay and non-compliance.
Officers,who would be directly responsible for issuing approvals,no-objection certificates and other clearances would be nominated as designated officers. First appeal officers will deal with appeals of entrepreneurs against non-issuance of clearances within the time-period stipulated in the new law.
In case,the first appeal officer finds that there is a lapse on the part of the designated officer,then he would have the power to impose penalty. In case of non-satisfaction at this level,a second appeal could be made with second appellate authority,which will examine the case and will decide the issue. An official statement described it as an exclusive law and a pioneer initiative towards ensuring time-bound issuance of clearances to industries.
