Kunda murders: HC seeks CBI’s letter on cops’ transfer

The court has fixed April 15 as the next date of hearing.

The Allahabad High Court on Wednesday directed the state government to bring on record,by way of an affidavit,the request letter sent by the CBI to the state police asking for transfer of all policemen from Kunda circle for impartial investigation in the murder case of Deputy Superintendent of Police Ziaul Haque and two others of March 2. The court has fixed April 15 as the next date of hearing.

The court passed the order while hearing the petition of 88 policemen,out of a total of 111 who had been transferred from Kunda circle through an order on April 3. The petitioners — Bajrang Bahadur Singh and others — had sought quashing of the transfer order on various grounds.

Taking note of the allegations of the petitioners that the transfers were manipulated by the former cabinet minister Raghuraj Pratap Singh alias Raja Bhaiyya,the court also sought specific details about the nine policemen,who were not transferred. The petitioners had alleged that they were spared because of their close proximity with Raja Bhaiyya.

Passing the order,a single judge bench of Justice V K Shukla said: “This court is of the firm opinion that all these facts (pertaining to the request letter of CBI) be brought on record by means of affidavit and at the point of time when affidavit is to be filed,specific reply shall also be given of the averments,which have been mentioned in paragraph 14 of the writ petition in question,(wherein) it has been mentioned that police personnel who are closely affiliated with the respondent No. 6 (Raja Bhaiyya) have been kept on hold whereas other 111 police personnel have been transferred.”

Earlier,when the hearing began,Piyush Shukla,counsel representing the state,submitted that the transfers were effected in pursuance of a CBI letter sent to the Director General of Police on March 28,in which it was requested that all policemen under Kunda circle be transferred for free and fair investigations.

The court noted: “His (state counsel’s) submission is that whatever action has been taken,the same has been taken in pursuance of the request made by the CBI and there is no selective action whatsoever…”

On March 2,Nanhey Yadav,pradhan of Balipur village under Hathigawa police station area,was murdered leading to a chain of events in which Haque and pradhan’s younger brother Suresh Yadav were also killed.
