HC sets 2014 deadline for Kanshi Ram Nagar to remain a district

The Allahabad High Court has directed the state government to put in place necessary infrastructure for smooth running of the district administration of Kanshi Ram Nagar by March 31,2014,or else the 2008 notification issued for creation of the district will get automatically quashed.

The Allahabad High Court has directed the state government to put in place necessary infrastructure for smooth running of the district administration of Kanshi Ram Nagar by March 31,2014,or else the 2008 notification issued for creation of the district will get automatically quashed.

Kanshi Ram Nagar district was carved out of Etah by the Mayawati government on April 17,2008.

The court passed the order while hearing a PIL filed by Collectorate Bar Association (Etah) seeking quashing of the 2008 notification on the ground that no budgetary allocation was made for setting up the infrastructure before creating the new district. The petition was filed in 2008 within a few months of creation of the district.

Passing the order today,a division bench of Acting Chief Justice Amitava Lala and Justice P K S Baghel said: “We grant a reasonable time to the state government to complete the infrastructure and use the budgetary sanction,that too not in a periodic or phased manner but at a time considering the case as emergent one. For such purpose we direct the state government to complete the course of action within the next financial year,which will come to an end by 31 March 2014. If it is not completed within the aforesaid period,the notification dated 17 April 2008.will automatically stand quashed. We hope and trust that all the works will be started and completed within this period on war footing.”
