The Allahabad High Court on Friday reserved its order in connection with a petition challenging the provision for appointment of administrators for urban local bodies (ULBs) after their term expires.
The term of the elected ULBs in Uttar Pradesh expired on November 15 and the government has passed orders for appointment of administrators. The petition was filed by Sabina,chairperson of Zila Panchayat,Bareilly.
A division bench comprising Justices Vineet Saran and Pradeep Kumar Singh Baghel reserved the order after hearing the arguments of both sides.
Petitioner Sabina,through her counsel Chandan Kumar,had argued that the provision under Section 10 (1) (4) of the UP Municipalities Act,1916,was unconstitutional. It was further prayed before the court that the elections to the ULBs should be held after the term of the present ULBs expired on November 15 and,till such time,no administrators should be appointed.
The state government had maintained that,as far as the legality of the provision was concerned,it had already been upheld by another division bench of the same high court in an order passed in 2006. The petitioner in that case was current MLA Anugraha Narayan Singh. The state government,through Chief Standing Counsel M C Chaturvedi,has maintained that if the court wanted to go beyond the 2006 order,it would have to refer the matter to a larger bench.
