A city court here has ordered registration of an FIR against SP MLA Prashant Kumar Singh on a complaint alleging he lied about his age to contest the Handia by-election in May.
Singhs father Mahesh Narayan Singh was the incumbent MLA of Handia,having won for the second time in the 2012 Assembly elections. The seat,however,fell vacant when he died in February this year.
In the by-election held subsequently,Prashant Kumar Singh polled over 81,000 votes and defeated BSPs Pankaj Tripathi by over 26,000 votes.
Sunil Kumar Tripathi,an Independent candidate in the by-election,lodged a complaint against Singh under Section 156 (3) of the Criminal Procedure Code.
The court of special Chief Judicial Magistrate Satish Chandra Dwivedi passed the order to register an FIR against Singh Friday on the basis of Tripathis complaint.
The complainant alleged there was manipulation related to the age of the sitting MLA. The court,prima facie,found the allegations serious and ordered a probe following registration of FIR at Colonelganj police station, said District Government Counsel (DGC) Ranendra Pratap Singh.
The district election office,where the alleged manipulation was carried out,is located under the Colonelganj police station area.
Circle Officer (Colonelganj) Ajay Kumar Singh said he heard about the order through the media and was not sure if the FIR has been registered or not.
Tripathi,in his application,alleged the minimum age to be eligible contest the election for MLA was 25 years,while Singhs age at the time of filing nominations was less. According to the complaint,the high school certificate showed Singhs date of birth as October 25,1989,which means he had not turned 25 when he filed his nomination on May 11.
