legal battle: Parveen Azad files case for share in property,in-laws say she wants insurance money

Four months after DSP Ziaul Haque was murdered at Kunda in Pratapgarh district,a dispute has broken out between his widow and parents over money and property.

Parveen Azad,who is serving as officer on special duty (OSD) in UP Police,has filed a case in Deoria’s civil court against her in-laws,Shamshul Haque and Azra Khatoon,seeking transfer of her share in movable and immovable property in her name.

The case was filed on July 11 and the court has fixed July 26 for hearing.

DSP’s father Shamshul Haque,however,says Azad has taken the matter to court due to a different reason.

He said: “Ziaul had taken two LIC policies in 2009 and had made his parents (Shamshul Haque and wife Azra Khatoon) nominees. As all formalities were completed,the LIC sent a letter to collect Rs 9 lakh and Rs 3.20 lakh on June 27 due against the two policies in the names of Shamshul and Azra,respectively.”

However,an LIC official informed him that Parveen Azad had on June 25 filed an objection with LIC,claiming she was the claimant of the insurance money against the two policies being the wife of the policy holder.

Taking cognizance of the objection,the LIC asked her to prove herself a nominee and claimant for the policies and submit an authentic document in this regard within

45 days.

“In an attempt to procure a legal document to claim herself a nominee of Ziaul Haque,Parveen Azad filed a case in the civil court in July 11 seeking court’s intervention to get her share in the property as being widow of my son,” said Shamshul Haque.

He has received the court’s notice to appear in the hearing fixed for July 26.

He said Parveen could not claim the two policies as she got married to his son in 2012 while the policies were taken in 2009 and they were named as nominees then,added Haque.

“After attending the chaliswa (a ritual after 40 days of death),Parveen left the Zuafar Tola village and settled in Lucknow. She is posted as OSD and drawing the salary equivalent to her husband. She is also getting the same amount as pension following government order. She never contacted or enquired about them,alleged Haque.

Parveen had come to their house once only the day she had filed the case on July 11,he said.

Despite several efforts,Parveen Azad could not be contacted.

The Akhilesh Yadav government had handed over cheques of Rs 25 lakh each to Parveen and Shamshul Haque after Ziaul’s murder. The government also had treated it as a special case and had ordered for appointments of Parveen and Ziaul’s brother Sohrab for jobs in UP police.

Ziaul Haque was allegedly shot by family members of pradhan Nanhey Yadav at Balipur village in Hathgawan police station area of Pratapgarh on March 2. Ziaul,who was then posted as circle officer of Kunda area,had reached the village to control the law and order situation after Nanhey Yadav’s murder who was shot earlier in the evening.

The CBI was handed over the investigation into the case. The agency had arrested the accused and had also filed the chargesheet in Ziaul Haque’s murder case.
