The state CID (Crime Branch) moved an application before the Kanpur court on Saturday appealing for the release of Munnalal Lodhi arrested in connection with the death of 12-year-old Divya Singh after a vicious sexual assault on September 27.
This,however,comes on a day when Munnalal was granted bail he had recently moved an application before the court. The application by the Crime Branch was moved under Section 169 of the CrPC (release of accused when evidence deficient). Munnalal Lodhi,a neighbour of the victim,was arrested by the Kanpur police on October 6 on charges of sodomy and murder.
The court admitted our application,in which,we have requested that Munnalal against whom till now no evidence has been found be released, said Inspector A K Singh the investigating officer of the case. The court has accepted the application,he added.
The report of the DNA test on suspects and investigation by the CB-CID into the case had nailed Piyush Verma the younger son of Chandra Pal Verma owner of Bharati Gyan Sthali School in Roshan Nagar where Divya was a student.
The DNA test showed a match of the Y-STR profile of Verma and his sons Mukesh and Piyush with spermatozoa found on Divyas undergarment and skirt. Investigations eliminated Mukesh and Chandra Pal,establishing Piyush as the likely offender.
Chandra Pal and his sons are lodged in jail. The CB-CID had filed a chargesheet against Chandra Pal and Mukesh under Section 304 of the IPC (punishment for culpable homicide not amounting to murder).
The investigation is on and we will soon file supplementary chargesheet in the case. The chargesheet against Chandra Pal and Mukesh was filed a week ago, said A K Singh.
Divya died on September 27 and the Kanpur police had arrested Chandra Pal and Mukesh on September 30 on charges of negligence. On October 6,Lodhi was arrested. Piyush was arrested on October 15 on charges of negligence. The case was handed over to the CB-CID on October 23.
