Congress candidate from Deoria Baleshwar Yadav,his son,ex-party MLC JP Jaiswal and two others were arrested on Wednesday night for assaulting a local BSP leader. The charges also included attempt to murder.
Following the arrest,Congress workers held a demonstration outside the Kushi Nagar police station,protesting against the alleged misuse of the government machinery. The police had to use force to disperse the mob. On Thursday noon,all five were released on bail.
Kushi Nagar Superintendent of Police,Love Kumar,told The Indian Express: While producing the accused,the police had submitted a report stating that the allegation of attempt to murder was not corroborated in the primary investigation. The Section 307 of the IPC was initially lodged as the victim had alleged that the accused had fired at him.
The incident had taken place in Patherwa,part of the Deoria constituency.
Baleshwar and BSP election in-charge Kalamuddin had a tiff while visiting the Kusia Mathiya village for canvassing.
Thereafter,Baleshwar and his associates had assaulted Kalamuddin,causing serious injuries,said Salig Ram,Additional Superintendent of Police,Kushi Nagar.
In the FIR lodged at the Patherwa police station,Kalamuddins driver Chhoteylal Gaur named Baleshwar,his son Brijendra,a police guard,ex-MLC Jaiswal and five others. The case was registered under Sections 147 (punishment for rioting),307 (attempt to murder),323 (punishment for voluntarily causing hurt),341 (punishment for wrongful restraint),504 (insult with intent to provoke breach of peace) and 506 (punishment for criminal intimidation) of IPC and 7-Criminal Amendment Law Act (CLA). The Congress candidate,his son and three others were arrested. They were released on bail later as the police report submitted before the court exempted the accused of the charges of attempt to murder and the 7-CLA. The allegations about these two charges were not corroborated during the investigation,the ASP added.
The Congress called the arrest an act of mere frustration by the ruling BSP. All the charges against our candidate are fake. The BSP government has deliberately done this to malign the image of our candidate, said Subodh Srivastava,chief spokesperson,UP Congress Committee.
In Deoria,our direct fight was with Mohan Singh of the Samajwadi Party, he said. This did not go down well with the BSP. The BSP candidate,Gorakh Prasad Jaiswal,was spending a huge amount of money over the past few months for publicity and holding langars for the poor. But still,the people were not in his favour. So out of frustration,the BSP took this step, he said.
