Following the Portugal High Courts order revoking the extradition of gangster Abu Salem,his lawyer on Monday moved an application before a local court seeking a stay on his trial in a case of obtaining passport on fake identity.
The application is listed for hearing on Tuesday in the court of Special Judicial Magistrate K Shukla,said Salems advocate Amir Naqvi.
The case dates back to 1997 when the CBI lodged an FIR against Abu Salem,his wife Samira Jumani and a middleman Pervez Alam for forging documents and procuring passports under fake names from the Lucknow Regional Passport office on July 6,1993.
The case was registered after Salem was caught carrying the passport at Dubai airport in 1997.
The CBI investigated the case and filed the chargesheet against Pervez Alam in 1999,while Salem and his wife were shown as absconders.
Later,when Salem was brought to India from Portugal,the CBI filed supplementary chargesheet against him.
