8 yrs on,FIR lodged in ‘fake’ encounter case

FIR lodged by 25-yr-old victim’s mother names four policemen,4 others.

The Muzaffarnagar police have registered an FIR against eight persons,including four policemen,for allegedly kidnapping a 25-year-old youth,Waseem,and killing him in a fake encounter in Moradabad in 2005.

The case has been registered on the direction of Muzaffarnagar chief judicial magistrate’s court.

The case has been registered at the Meerapur police station last evening.

The state government has already given a compensation of Rs five lakh to Waseem’s mother Hashmi,who is the complainant in the case,on the direction of the National Human Right Commission in August last year. In such cases,the amount released from the government is realised from the salaries of the erring policemen.

Waseem,a resident of Muzaffarnagar’s Meerapur town,used to run a barber shop.

Meerapur police station SHO AK Gautam said the four policemen named in the FIR are station officer of Meerapur police station,a sub-inspector and constables Abid and Rampal. Others named in the FIR are local residents Akhtar,Fayaaz,Kallu and Gulshar

Investigating Officer (IO) in the case,inspector NK Sharma,who is attached with Meerapur police station,said constable Rampal had died about two years ago.

Hashmi said,“ We had an enmity with four of the locals who are named in the FIR. The four had conspired with the policemen at local police station and got my son killed in a fake encounter.”

Waseem is survived by his wife Sultana,mother,a brother and sister and two children in the family.

After his death,the family filed complaints with the Muzaffarnagar and Moradabad police alleging that the encounter was fake. As the police did not lodge an FIR,Hashmi moved the local court seeking direction to lodge the FIR against four of the local residents and the policemen.

She also had filed a complaint with the NHRC that conducted an inquiry.

According to Hashmi,on May 26,2005,two policemen visited her house to inform that Waseem along with another person,Gufran,has been killed in a police encounter in Moradabad. The family reached Moradabad and took the body after the post-mortem examination. The police told Waseem’s family that the two were killed in an exchange of fire. “Later we came to know through newspapers that Gufran had criminal cases against him. No case was ever registered against Waseem,” said Waseem’s brother Haseen.
