THE CBI on Monday filed its first chargesheet in connection with the rape and murder of a junior doctor at R G Kar Medical College and Hospital, holding Sanjay Roy, a civic volunteer with Kolkata Police, as the sole accused in the case.
The body of the junior doctor was found on August 9 inside the seminar room of R G Kar’s emergency building, where, according to the chargesheet, she was resting during night shift.
The rape and murder triggered widespread outrage and led to a prolonged strike by doctors across West Bengal. Roy, a civic volunteer attached to the police outpost at the hospital, was arrested soon after and subsequently, the case was handed over to the CBI.
On Monday, 58 days after the rape-murder, the CBI filed a 45-page chargesheet in the Additional Chief Judicial Magistrate’s court in Sealdah, stating that Roy committed the crime. The chargesheet did not mention gangrape, said sources in the CBI, referring to allegations about involvement of others. They said the chargesheet highlighted that the probe so far has revealed only Roy’s direct involvement in the rape and murder.
“Sanjay Roy has been charged with rape and murder. There is no mention of a gangrape (in the chargesheet). Sanjay Roy is the only accused who committed the crime. However, the probe is still going on. He was in an inebriated condition when the crime was committed. This is mentioned in the chargesheet,” said a CBI source.
According to the chargesheet, CCTV footage showed Roy entering the seminar room where the doctor was resting around 4 am on August 9 and leaving after around 30 minutes. According to sources, the blood and tissue found from the victim’s nails matched with Roy’s DNA.
The CBI attached the forensic report and Roy’s DNA report with its chargesheet.
The chargesheet mentioned that there were 16 external and nine internal injuries on the doctor’s body. The CBI also said in the chargesheet that Roy tried to mislead the investigators during questioning.
CBI sources said Roy has been charged under BNS sections 64 (rape), 66 (causing death or resulting in persistent vegetative state) and 103(1) (murder). A source said the punishment under BNS Section 66 is rigorous imprisonment for not less than 20 years — it can extend up to life imprisonment — or the death penalty. Under Section 103 (1), the punishment is death or life imprisonment.
On September 14, the CBI had arrested Sandip Ghosh, the former principal of R G Kar Medical College, and Abhijit Mondol, the then officer in-charge of Talal police station, in connection with alleged tampering of evidence in the case and allegedly trying to “hush up” the incident.
