A Public Interest Litigation (PIL) has been filed in the Calcutta High Court seeking a stay on suspended Trinamool Congress (TMC) MLA Humayun Kabir’s plan to lay the foundation stone for building a mosque modelled on the Babri Masjid, in Murshidabad district on December 6.
Advocate Sabyasachi Chatterjee, the petitioner’s counsel, has filed the PIL seeking an urgent hearing, requesting the court to take immediate action against Kabir’s provocative remarks that have allegedly disrupted communal harmony.

The matter will be heard by a division bench of Acting Chief Justice Sujoy Pal.

The petition mentions, “The writ petition pertains to stop foundation stone laying of Babri Masjid in Beldanga Block 1, Murshidabad to maintain Law and order. Mr. Humayun Kabir, Member of Legislative Assembly of Bharatpur, has decided to lay the foundation stone for a structure of Mosque named “Babri Masjid” in the Beldanga 1 block of Murshidabad on 6th December, 2025…… MLA has been using filthy and derogatory statements and hate speech against a community which causes breach of public tranquility. Such kind of statements and hate speech over social media and you tube news portal, being a Member of Legislative Assembly may break the communal harmony of our state as well as our country.”

Kabir while speaking to media persons said, “I have consulted with my legal counsel, they will appear before court and put forward their arguments.”

Over the past one year, Kabir has repeatedly criticised the party, prompting warnings from Chief Minister and TMC-supremo Mamata Banerjee and Abhishek Banerjee that such behaviour would not be tolerated.
