Calcutta High Court Wednesday directed the CID to conduct fresh probe into the alleged murder of a sub-inspector in the Shayampur police station and submit the report in six months. Delivering the order,Justice Sanjib Banerjee,also stayed the criminal proceedings pending in Ulberia court.
SI Amar Sarkar,received a bullet injury on October 19,2012 and was admitted to the local hospital,where he died a few days later.
A probe was initiated,but no progress was made. His brother Dilip Sarkar approached the Ulberia Court for investigation to be carried out by the District Police. DSP(Rural) of Howrah district submitted a report on the direction of the court,which stated Sarkar received the bullet injury when his colleague Prabir Ghosh was cleaning his service revolver. Police had also filed a charge-sheet in the Ulberia court.
Dilip then approached the Calcutta High Court demanding CBI probe on the ground the district police did not conduct proper investigation. In the petition,it was alleged that Prabir Ghosh killed his brother,but police tried to suppress facts. The petition pointed out the FIR was lodged under Section 302 of the IPC,but the charge-sheet it was filed under Section 304 of the IPC.
