Former Sona Comstar chairman Sunjay Kapur and his third wife Priya Kapur drew up their wills on the same day, and used the template that was used by Sunjay’s mother Rani Kapur for her will, Priya Kapur told the Delhi High Court on Thursday. She made the remarks while rebutting the allegations by Sunjay’s children with his former wife actor Karisma Kapoor.
Senior advocate Rajiv Nayar, appearing for Priya, submitted before Justice Jyoti Singh on Thursday that both “mine (Priya) and deceased’s (Sunjay’s) wills were made on the same day, which is customary for a husband and wife…”. “There is nothing suspicious about a husband giving everything in his assets to his wife…(The will used) a template…I was reluctant to show (it) because of confidentiality but the template is based on my mother in law’s (Rani Kapur) will…there are spelling errors because of the template it was taken from,” the High Court was told.
Nayar took the court through Rani Kapur’s will to substantiate the similar spelling errors and erroneous pronouns, which had been earlier flagged in the court by Sunjay’s children.
However, the fresh submission comes only orally, and has not been included in the written submissions made by Priya earlier.
Sunjay’s children with actor Karisma Kapoor — Samaira and Kiaan — are locked in an inheritance battle, primarily with his third wife Priya Kapur, over the personal assets of the former Sona Comstar chairman, claiming their share as Class-1 or immediate heirs. Sunjay Kapur died in June due to cardiac arrest during a polo match in the United Kingdom.

One of the aspect flagged by Karisma’s children were that the purported will left by Sunjay misspelt the name of his son with Priya, Azarias; referred to himself as ‘her’ and ‘testatrix’, and that Karisma’s children or Karisma were never made aware of such a will which only “surfaced suddenly” under “mysterious” and “suspicious” circumstances.

Emphasising that it is not a case of “disinheriting” Karisma’s children, Nayar further emphasised, “Our case is, both (Samaira and Kiaan) received beneficial interest to the tune of Rs 2,000 crore under the trust (RK Trust).”
