Sunjay Kapur estate battle: Karisma’s children face off with Priya Kapur in Delhi HC — Key arguments so far

For the last few weeks, a high-stakes inheritance battle over late businessman and Sona Comstar chairman Sunjay Kapur’s personal estate worth thousands of crores has been playing out in the Delhi High Court. The dispute is between Sunjay’s children from his second marriage to Karisma Kapoor — Samaira and Kiaan — and his third wife, Priya Kapur.

Karisma’s children, through their suit, have claimed their share as Class-1 or immediate heirs; they said they have not received any bequeathal in Sunjay’s purported will, which they termed suspicious and questioned its genuineness.

Sunjay’s mother, Rani Kapur, who too has not received any bequeathal in Sunjay’s will, has supported Karisma’s children’s demand and has echoed the “suspicious” nature of the will.

Sunjay died of a heart attack at the age of 53 while playing polo in London in June after being stung by a bee. As per his will, most of his personal estate has been bequeathed to Priya and Priya’s children — Azarias (Sunjay’s son with Priya) and Safira (Priya’s daughter from her previous marriage with hotelier Vikram Chatwal).

As of Monday, all parties involved in the case have had an opportunity to present their arguments before the court.

What have been the key arguments so far

Samaira and Kiaan have argued that:

– Priya allegedly “connived” with the executor and other associates who were witnesses to Sunjay’s will “to usurp their rightful shares”.

-.The will is bogus, with “unimaginable errors” — such as the will misspelling his son Azarias’ name; mentioning the wrong address of Karisma’s children — and only reflects a “digital footprint of conspiracy” where the will originated and was stored in Priya’s associate’s device, and not Sunjay’s. It was further argued that a meticulous businessman like Sunjay would not have allowed such errors to remain, thus making the will “suspicious”.

– The will being propounded was not registered, and it was the duty of the executor of the will — Shradha Suri Marwah, who is also the Chairperson and Managing Director of Subros Ltd — to not blindly accept and propound the purported will in light of the lapses/errors present in it.

– There has been suppression of Sunjay’s personal assets in the list of assets furnished by Priya owing to a court order, including assets such as crypto investments, insurance, artworks, jewellery, etc.

– There was no occasion for Sunjay to have suddenly decided to execute a so-called will, months before his death. Further, had he executed the will, he would have informed Karisma or the children of the same. The will also leaves his mother out.

Priya Kapur has argued that:

– Karisma’s children have received Rs 1,900 crore worth of assets from the family’s RK Trust, so Sunjay deemed it fit not to make any further bequeathal.

– Questions over the genuineness of the will are being raised without challenging the will in the suit; the suit is only confined to the probate jurisdiction at the moment.

– Sunjay’s divorce from Karisma was acrimonious, thus, there is nothing unusual if Sunjay left his children with Karisma out of the confines of the will while providing sufficiently for them from the family trust. Further, there is nothing unusual for a husband to leave all his assets to his present wife.

– Sunjay’s will was drafted using his mother’s will as a template, thus, the errors that have crept in are similar.

– Karisma’s children have selectively omitted presenting the evidence of the digital trail of the will to claim it to be suspicious, whereas the digital trail is well accounted for.
