Seal 976 factories running without permits in Gandhinagar: High Court to civic body

The court has also warned the civic body of contempt of court proceedings if the sealing is not done.

Nearly 10 years after the Supreme Court issued directions to close down all “illegal” industries in Delhi,the Delhi High Court has directed East Municipal Corporation to seal over 900 industrial units operating from residential premises in Gandhinagar,East Delhi.

The court has also warned the civic body of contempt of court proceedings if the sealing is not done.

A bench of Justice Pradeep Nandrajog and Justice V Kameswar Rao issued the order in a PIL filed by a group of Gandhinagar residents who had alleged that several factories in the area did not have proper permits.

“Learned counsel for the Municipal Corporation of Delhi as also the Government of NCT Delhi concede that the status report which reflects the data collected after inspecting 976 properties reveals violation of the Master Plan for Delhi 2021,” the court said.

East corporation had conducted a survey of Gandhinagar in June and submitted before the court a status report with details of the illegal factories there.

The court has now directed the civic agency to seal all buildings. The agency has also been directed to intimate Jal Board and the concerned power discom to stop supply to those building.

“Any violation of this order would be treated as an act of contempt by the Commissioner of the East Municipal Corporation.

The petitioners are free to take resort to contempt proceedings against the Commissioner of the East Municipal Corporation should there be any violation,” the court said.

In May,the court had pulled up police and East corporation for failing to conduct a survey of the area after the two agencies had blamed each other for the delay.
