The list of 13 defence witnesses in the Aarushi Talwar – Hemraj double murder case,submitted to a Ghaziabad court by the defence counsel was opposed by the prosecution on Thursday.
The prosecution opposed the list,submitted to a sessions court on Wednesday,calling it irrelevant to the case.
Names on the list included R K Sharma (former head of department forensics AIIMS),Dr Urmil Chaddha (gynaecologist),Dr S L Vaya (who conducted the narco-analysis test),three of Talwars family friends Masooma Jha,Rajender Kaul and Vikas Sethi,two nodal officers from the Airtel and Vodafone,Arun Kumar (former Addl DG UP Police) and others.
Prosecution lawyer R K Saini said,The doctors that the defence wants to call as witnesses have not even seen the dead body and thus they cannot comment on it. The gynaecologist on the witness has not analysed the victims.
Saini said the doctor who conducted the narco analysis test should also not be summoned as the report is not admissible in the court and thus cannot be used as evidence.
The court also heard arguments on the applications submitted by the Talwars counsel to allow Dr R K Sharma access to the case evidence,while also putting on record the reports of scientific tests conducted by the investigating agency.
When the said reports are not admissible in court as evidence,then why does the defence counsel want to waste time in getting it re-examined by their expert. We are just awaiting orders from the court, Saini said.
The prosecution has opposed our list,now the court will take a call on it… on Monday, Tanvir Ahmad Mir,Talwars counsel said.
