In a status report filed before the Delhi High Court, the Delhi Police has claimed that TERI director R K Pachauri — accused of sexual harassment by a woman employee — was “not cooperating with the investigation” and was “influencing witnesses and misusing the liberty of bail”.
The police report supports the plea filed by the 29-year-old employee, who had sought cancellation of the anticipatory bail granted to Pachauri by a trial court in March. She had alleged that a “free and fair investigation” cannot be carried out if Pachauri was “allowed to roam around freely”.
During the hearing on Thursday before the bench of Justice S P Garg, police submitted that Pachauri was evasive during questioning and not co-operating with probe agencies. The court has, for now, declined to issue any interim orders and has adjourned the matter for disposal on July 30.
Countering the allegations raised by police and the woman, Pachauri’s counsel Ramesh Gupta argued that there was “nothing on record to suggest that he has ever influenced witnesses or any other persons related to the present case, or interfered in the investigation”.
Meanwhile, police said “Pachauri was questioned four times… at his residence in the presence of his lawyer, but he was not cooperating with the investigating agency and (has) avoided giving proper replies to questions put before him”.
Police also stated that the investigation was at a “crucial stage”.
“FSL (forensic) report in the matter with regard to tampering/ hacking mobile phones, computers, laptops and other electronic gadgets from which the messages/e-mails that were sent to the complainant by the respondent 2 (Pachauri), is awaited… Detailed custodial interrogation of Pachauri is required to ascertain the true facts of the case as he is giving evasive replies to questions put to him. He is misusing the liberty of anticipatory bail and is influencing witnesses by giving them certain directions…” the report stated.
The probe agency further said it had written to the chief of the forensic lab in Gandhi Nagar, Gujarat, to give an opinion at the earliest with regard to tampering/hacking of electronic gadgets/devices.
